By the present Application, the Applicants had sought for the following substantive reliefs :- "(b) This Hon'ble Court be pleased to exercise is inherent power u/S. 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023, thereby to quash and set aside the F.I.R. bearing C.R. No. 450 of 2025 dated 08.11.2025 u/S. 351(3), 329(1), 126, 3(5) of Bhartiya Nyaya Sanhita, 2023 along with S.37(1) and 135 of the Maharashtra Police Act, 1951 registered at Kalepadal Police Station, Dist.: Pune and discharge the Applicants/Accused for the charges leveled against them;"

On 14th January, 2026 the following order was made :- 1.

After arguing this matter for substantial time, Mr. Siddharth Sutaria, learned Advocate for the Applicants requests for adjournment till 16th January 2026 to take instructions.

At the request of Mr. Sutaria, list the matter on 16th January, 2026.

3.

Today, Mr. Siddharth Sutaria, learned Advocate for the Applicants, on instructions from the Applicants, craves leave to withdraw the present Application with liberty to file appropriate Application before the Trial Court.

Mr. Prasanna Malshe, learned APP for the State, does not object to the grant of liberty to withdraw the present Application.

5.

In view of the above, liberty granted to withdraw the present Application. Applicants are always at liberty to file Application before the Trial Court if permissible in law. Any such Application, if filed, would be considered on its own merits and in accordance with law.

Criminal Application No. 21 of 2026 is dismissed as withdrawn.
