CRIMINAL APPELLATE JURISDICTION APPLICATION NO. 80 OF 2026 Sandeep Kalra ..Applicant

Versus

State of Maharashtra

...Respondent

Mr. Kuldeep Patil, with Ramsing Rajput, i/b Agrud Partners, for the Applicant Smt. R.S. Tendulkar, APP, for the Respondent-State. Mr. Dhuri, PSI, EOW, Unit No. 8 present.

CORAM:

N. J. JAMADAR, J.

DATE :

22nd JANUARY 2026 P.C.:

1.

Heard the learned Counsel for the Petitioner. 2.

The challenge in this Petition is to an order dated 8th October ARUN RAMCHANDRA SANKPAL 2025, whereby the learned Civil Judge has partly allowed the Application to travel abroad for a period six months only, when the by ARUN RAMCHANDRA SANKPAL Date: 2026.01.23 19:08:38 +0530 Applicant had sought permission to travel abroad for one year. 3.

It appears that the learned Special Judge considered it appropriate to grant permission for six months only as the proceedings are pending before the Supreme Court, wherein stay has been granted to the trial in MPID Special Case No. 1 of 2017 and, thus, there was a possibility of the stay being vacated.

23-APL-80-2026.DOC 4.

Mr. Patil, the learned Counsel for the Petitioner, on instructions, submits that the stay still continues to operate. 5.

In these circumstances, the Petitioner is permitted to file an application before the trial Court and seek extension of the period to travel abroad, in the second week of March 2026. In that event, it may not be necessary for the Petitioner to appear before the learned Special Judge, to surrender the passport and furnish FDR. 6.

In the event, such an Application is filed, the learned Special Judge, shall pass an appropriate order albeit after ascertaining whether stay by Supreme Court to the trial in MPID Special Case No. 1 of 2017, operates.

7.

Application disposed.
