Heard the learned Counsel for the parties.

The challenge in this Petition is to an order passed by the learned Special Judge in NDPS Special Case No. 1387 of 2022 of issue of NBW ARUN RAMCHANDRA SANKPAL against the Applicant.

The learned Counsel for the Applicant, on instructions, submits that the Applicant is willing to appear before the learned Special Judge on the next scheduled date and will continue to appear before the learned Special Judge in the said Special Case. 4.
In view of the aforesaid statement and the willingness of the Applicant to appear before the learned Special Judge in NDPS Special ARS 1/2
20-APL-95-2026.DOC Case No. 1387 of 2022 and cooperate with the Court for an expedite conclusion of the trial, the Court considers it appropriate to provide an opportunity to the Applicant to appear before the learned Special Judge and seek the cancellation of NBW and, in the meanwhile, stay the execution and operation of the NBW.

The Application stands disposed with liberty to the Applicant to appear before the learned Special Judge on or before 1st April 2026 and seek cancellation of NBW.

In the meanwhile, till 1st April 2026, the execution and operation of the NBW shall remain stayed.

In the event, the Applicant appears before the Special Judge and seeks cancellation of NBW, the learned Civil Judge may have due regard to the fact that the Applicant has appeared before the Court and undertakes to appear before the Court in future and cooperate the Court in the expeditious conclusion of the trial, and pass an appropriate order.
