This Application under Section 528 of BNS is preferred against the FIR bearing No. 004 of 2025 registered on 15/12/2025 with Dombivali Police Station, Dist - Thane (City) on the complaint lodged by the Respondent No. 2 for the offences punishable u/s. 351(2), 352 (2) and 69 of Bharatiya Nyaya Sanhita, 2023 R/w. Section 66 (E) of Information Technology Act, 2000.

Applicant is present in Court along with his Advocate Mr. Swapnil Chopade. Respondent No. 2 is present in Court along with her Advocate Mr. Hrishikesh Giri.

Mr. Swapnil Chopade and Mr. Hrishikesh Giri, jointly submit that the Applicant and Respondent No. 2 have amicably resolved their dispute. They submit that in view of the resolution of the dispute Respondent No. 2 has no objection for quashing of the FIR impugned in the present Application.

Mr. Hrishikesh Giri tenders the affidavit dated 29th January, 2026 affirmed by the Respondent No. 2 before the Registry of this Court, same is taken on record and marked 'X' for identification. Respondent No. 2 who is present in Court states that the Affidavit (X) is filed out of her own free will and without any pressure or coercion from any person. She reiterates the contents of the affidavit (X) and states that she has no objection for quashing of the impugned FIR.

Mr. S. A. Karmakar learned APP submits that in view of the Affidavit (X) filed by the Respondent No. 2 and statements by her before this Court, no purpose would be served in continuing with the criminal proceedings. He submits that the Investigation Agency was made to work on the basis
of the complainant filed on the Respondent No. 2, as such parties are required to be saddled with cost.

Mr. Swapnil Chopade and Mr. Hrishikesh Giri on instructions from the Applicant and Respondent No. 2 submits that they would jointly pay an amount of Rs. 25,000/- as cost. Cost of Rs 25,000/- be deposited in the following account i.e. Central Police Welfare Fund. Central Police Welfare Fund Director General M. S. Mumbai.

Mr. Swapnil Chopade and Mr. Hrishikesh Giri on instructions from the Petitioner and Respondent No. 2 states that said amount of Rs. 25,000/- will be deposited in the aforesaid account within a period of two weeks from today.

Considering the above said circumstances, the parties having resolved their dispute amongst themselves and the statements made by
the Respondent No. 2 in her affidavit (X), having regards to the pronouncements of the Supreme Court in the case of Gian Singh vs State Of Punjab1, Narinder Singh And Ors vs State Of Punjab And Anr2, Sandeep Singh Thakur vs State Of Madhya Pradesh And Anr.3, Parbatbhai Aahir @ Parbatbhai vs The State OF Gujarat4 there is no impediment in allowing this Application.

In view of the above and subject to payment of cost of Rs. 25,000/- Application is allowed in terms of prayer clause (a). Consequently, the FIR bearing No. 0904 of 2025 registered with Dombivali Police Station is quashed.

For reporting compliance on deposit, list the matter on 23rd February, 2026.
