The challenge in the present Criminal Application is to the order dated 12.12.2025, passed by the Special Judge under Narcotic Drugs and Psychotropic Substances Act, 1985, Bruhanmumbai Court No. 42, by which the Application filed by the Applicant seeking release of the property at Exhibit-15 on the file of Special Case (NDPS) No. 860 of 2025, was rejected. 3.
Mr. Sukanta Karmakar, learned A.P.P. for the State/Respondent on instructions submits that the impugned order be set aside, Application at Exhibit-15 on the file of Special Case
Gitalaxmi 6-APL-199-2026.doc (NDPS) No. 860 of 2025, be allowed and the matter be relegated to the Special Judge (NDPS) Court, for imposing appropriate conditions for release of the said vehicle. He makes the said request, as it would be appropriate for the Special Judge (NDPS) Court to impose appropriate conditions, as he deems fit and proper. 4.
Ms. Zehra Charania, learned Advocate for the Applicant consents to the said recourse suggested by Mr. Sukanta Karmakar, learned A.P.P and submits that the Applicant shall abide by the conditions for release of the vehicle, as may be imposed by the Special Judge (NDPS) Court.

By consent of the parties, impugned order dated 12.12.2025 passed by the Special Judge (NDPS) Court on Exhibit-15 in Special Case (NDPS) No. 860 of 2025, is set aside. Consequently, Exhibit15 is allowed. Special Judge (NDPS) Court is directed to release the subject vehicle by imposing appropriate condition for the release, as he may deem fit and proper to impose. 6.
Criminal Application No. 199 of 2026 is allowed in the above said terms.
