This Petition was taken up on 10th February, 2026 in view of the urgency in the case as stated by Mr. Shafi Sayed, learned Advocate for the Applicant.

On 10th February, 2026, this Court, after having heard Mr. Shafi Sayed, learned Advocate for the Applicant, Ms. Smita Jagtap, learned Advocate for Respondent No. 2 and Mr. Sukanta Karmakar, learned APP for the State had passed the order disposing of the said Application. Statements of the parties present namely the Applicant and Ms. Saltanat Khan (Wife of the Applicant) were recorded in the open Court. Documents tendered by the parties and the Advocates appearing for the Applicant and Respondent No. 2 were taken on record and marked as 'X-1' for identification.

However, at the time of signing the order in chamber it was noticed that Ms. Saltanat Khan, wife of the Applicant, though present in Court on 10th February, 2026 with her Advocate Ms. Smita Jagtap and being referred to as Respondent No. 2 by Mr. Shafi Sayed and Ms. Smita Jagtap, the cause title of the Criminal Application No. 202 of 2026 did not indicate Ms. Saltanat Khan as a party Respondent. In view of the same this Petition was directed to be placed on board under the caption "for directions" on 12th February, 2026.

Today, Mr. Shafi Sayed, learned Advocate for the Applicant states that there was a mistake on his part in not joining the Respondent No. 2 as a party to the present proceedings and further mistake on his part in not bringing the said fact to the notice of this Court. Mr. Shafi Sayed, tenders an apology for the said mistake. Mr. Shafi Sayed craves leave to join Ms. Saltanat Khan as Respondent No. 2.

Ms. Smita Jagtap also accepts the mistake in not pointing out the said fact of Saltanat Khan not being made a party to the present Petition. She tenders an apology for referring Ms. Saltanat Khan as Respondent No. 2 on 10th February, 2026. 7.
Mr. Sukanta Karmakar, learned APP for the State submits he has no objection to permitting the amendment. 8.
In the interest of justice, though this Application was allowed / disposed of on 10th February, 2026, Applicant is permitted to amend the cause title of the Criminal Application No. 202 of 2026 by joining Saltanat Khan as Respondent No. 2. Mr.
Shafi Sayed states that the amendment would be carried out forthwith. Permission granted.
