By the present Application, the Application is assailing the order dated 29 March 2025 by which the Appellate Court passed conditional order which reads as follows :- "The impugned dated 19.10.2024 in C.C.

1241/SS/2016 by Ld. M. M. 07th Court, Dadar, Mumbai is hereby stayed subject to depositing 20% of

(87) APL-253.26.DOCX compensation amount towards interim compensation within 60 days. If, the conditional order is not complied then suspension would stand revoked/vacated automatically without further reference of this Court. Hence, Criminal Miscellaneous Application No.2367/2024 is disposed of accordingly."

The present Petition is filed on 13 January 2026. Mr. Babu Singh, learned Advocate for the Applicant, states that the Applicant has made arrangement to deposit the 20% amount as directed by the Appellate Court and if permitted, the Application is ready to deposit the said amount before the Appellate Court.

Issued notice to the Respondents, returnable on 23 March 2026.

Mrs. P P Bhosale, learned APP appears and waives service of notice on behalf of the Respondent/State. 7.

Mr. Babu Singh states that spare copy of the Application would be furnished to the Registry of this Court on or before 16 March 2026 so as to enable service of notice on Respondent No.2.

At the request of Mr. Babu Singh Hamdast granted. He ensures the completion of service on the Respondent No.2 on or before the next date.
