Heard the learned Counsel for the applicant.

This application is filed being aggrieved by an order dated 08th January, 2026 passed by the Special Judge in Special Case No. 475/2024, whereby the non-bailable warrant has been issued against the applicant.

Mr. Hazra, the learned Counsel for the applicant submitted that, the applicant has been regularly appearing before the Trial Court and will continue to regularly appear before the Trial Court. The learned Counsel further submits that, the applicant/Accused No. 2 will appear before the learned Special Judge on 23rd March, 2026.

In view of the aforesaid submissions, the Court considers it appropriate to provide an opportunity to the applicant to SAINATH, PA 1/2

51 APL 412-26.DOC appear before the learned Special Judge and seek cancellation of non-bailable warrant issued against him.

Let the applicant appear before the learned Special Judge on or before 23rd March, 2026 and file an application for cancellation of the non-bailable warrant. In the event, the applicant appears before the learned Special Judge and files an application for cancellation of non-bailable warrant, the learned Special Judge is requested to decide the same in accordance with law, having regard to the fact that, the applicant undertakes to regularly appear before the Trial Court. 6.

In the meanwhile, to facilitate the applicant to appear before the learned Special Judge, the execution and operation of the non-bailable warrant shall remain stayed till the next date. 7.

The Application stands disposed.
