Through this Application, the Applicant has requested the following substantive relief:

"(a) That this Hon'ble Court mayb pleased to quash and set aside the F.I.R. No.No.43 of 2023 under sections 420, 427, 465, 467, 468 and 471 of the Indian Penal Code of IPC of IPC herein registered with Shivajinagar Police Station, dated 13th February 2023 on along with Chargesheet dated 18th January 2025 pending before the Court of Learned Addl. Chief Judicial Magistrate, Pune bearing R.C.C. No.577 of 2025."

After hearing the matter for some time, Mr. Ajay Basutkar sought a passover. At his request, the matter was taken up again after some time.

Mr. Ajay Basutkar, learned Advocate for the Applicant, on instructions from the Applicant, seeks leave to withdraw the present Application with liberty to file an Application seeking discharge before the Trial Court at the appropriate stage.

Mrs. P P Bhosale, learned APP for the Respondent/State, does not object to the request made by Mr. Ajay Basutkar. 5.

In view of the statement made by Mr. Ajay Basutkar, learned Advocate for the Applicant, leave is granted to withdraw the present Application with the liberty as prayed for. If an application for discharge is filed before the Trial Court at the appropriate stage, the same shall be considered on its own merits and in accordance with the law. 6.

Criminal Application No.474 of 2026 is dismissed as withdrawn.
