Mrs. Rajashri Newton, learned APP, submits that the impugned FIR which is produced on record at page nos.20 to 29, does not name the Applicant as an Accused.

Mr. Swapnil Shanbhag confirms the said fact. He therefore, on instructions, from the Applicant, craves leave to withdraw the present application. He however, seeks liberty to challenge the impugned FIR or the charge sheet in the event the Applicant is subsequently named in the criminal proceedings. Mrs. Newton, does not object to the said request.

In view of the statement made by Mr. Swapnil Shanbhag, leave is granted to withdraw the present application, with liberty to file appropriate proceedings in the event the Applicant is subsequently named in the crime which is subject matter of the present application. 4.
