By the present Application, the Applicant has sought the following substantive relief in terms of prayer clause (a), which reads as under:- "a) This Hon'ble Court be pleased to quash and set aside FIR bearing C.R. No.31/2026 registered with V.P. Road Police Station, Mumbai on 07.01.2026 for the offence punishable u/s 409 and 420 of the Indian Penal Code, 1860 and all the consequently proceedings initiated against instant Applicant".

Ms. Vrushali Maindad, learned Advocate for the Applicant, on instructions from the Applicant, seeks leave to withdraw the present Application with liberty to file an application seeking discharge before Sharada
3-APL-622-2026.doc the Trial Court at the appropriate stage. This request, made by Ms. Vrushali Maindad, learned Advocate for the Applicant, is not objected to by Mr. Sukanta Karmakar, learned APP for the State. 3.
In view of the statement made by Ms. Vrushali Maindad, learned Advocate for the Applicant, leave is granted to withdraw this Application with liberty, as prayed. If an application seeking discharge is filed before the Trial Court at the appropriate stage, the same is considered on its own merits in accordance with the law. 4.
This Criminal Application No.622 of 2026 is dismissed as withdrawn.
