By the present Application, the Applicant has sought for the following substantive relief in terms of prayer clause (a) :- A.
That this Hon'ble Court under its Criminal Appellate jurisdiction under Section 482 of the Criminal Procedure Code, read with Section 528 of the BNSS Act, be please to quash the entire FIR No. 25 of 2021 registered with Juhu Police Station and the charge sheet dt. 12th July, 2021, as well as the issuance of process / committal order dt. 12th July 2021 and the entire criminal proceeding being Sessions Case No. 565 of 2021 against the present Applicant for the reasons stated herein above in this application.

After having heard the matter for sometime, Mr. Rahul Kadam, learned Advocate for the Applicant sought a passover to take instructions from the Applicant. After some time, at his request, the Criminal Application was taken up. 3.
Mr. Rahul Kadam, learned Advocate for the Applicant, on instructions from the Applicant, craves leave to withdraw the present Application with liberty to file an Application seeking discharge before the Trial Court at the appropriate stage. 4.
Request made by Mr. Rahul Kadam, learned Advocate, is not objected to by Mrs. Rajeshree Newton, learned APP for the Respondent - State.

In view of the statement made by Mr. Rahul Kadam, learned Advocate for the Applicant and the no objection by Mrs. Rajeshree Newton, learned APP, leave granted to withdraw the present Application with liberty as prayed.

If an Application seeking discharge is filed before the Trial Court at the appropriate stage, same be considered on its own
merits and in accordance with law.

Criminal Application No. 668 of 2026 is disposed of as withdrawn.
