Mr. A. A. Palkar, learned APP states that against the Order impugned in the present proceedings an Appeal under Section 12 of the MCOC Act is maintainable.

In view of the said objection raised, Ms. Zehra Charania, learned Advocate for the Applicant on instructions from the Applicant craves leave to withdraw the present Application with liberty to file an Appeal under Section 12 of the MCOC Act. She requests for exclusion of the time spent in the present Application i.e. from the date of filing of this Application till the passing of this Order.

Mr. A. A. Palkar does not object to the said request. 4.

In view of the statement made by Ms. Zehra Charania, learned Advocate for the Applicant, leave granted to withdraw the present Application with liberty to file an Appeal under Section 12 of the MCOC Act. If the Appeal is filed within a period of 15 days from today, the Applicant would be entitled to claim exclusion of the time spent in the present Application in terms of Section 14 of the Limitation Act, 1973.

Criminal Application No. 686 of 2026 is disposed of as withdrawn.
