Heard Mr. C. G. Gavnekar learned Advocate for the Applicants and Ms. A. S. Gotad, learned APP for the State. 2.

By the present Application, the Applicants sought for the following substantive relief;

23(a) by a Writ of Mandamus or in by any other appropriate writ order, direction, your Lordship be pleased to quash and set aside the FIR No. 0042/2026 dated 13/01/2026 filed at the instance of Respondent No.2 with Panvel City Police Station, District Raigad and annexed at Exhibit-B hereto.

After having heard the matter for some time, Mr. C. G. Gavnekar, learned Advocate for the Applicant on instructions from the Applicants seeks leave to withdraw the present Application Supriya

9-APL-695-2026.doc with liberty to file an Application seeking discharge before the Trial Court at the appropriate stage. Request made by Mr. C. G. Gavnekar is not opposed by Ms. A. S. Gotad, learned APP for the State.

Mr. C. G. Gavnekar states that, Criminal Application No. 672 of 2026 filed by co-accused Mr. Sachin Keni was disposed of by Order dated 15th April 2026.

In view of the statement made by Mr. C. G. Gavnekar, learned Advocate for the Applicants, leave granted to withdraw the present Application with liberty as prayed. If an Application seeking discharge is filed before the Trial Court at the appropriate stage, the same be considered on its own merit and in accordance with law.

Criminal Application No. 695 of 2026 is disposed of as withdrawn.
