By the present Criminal Application, the Applicant has sought for the following substantive relief in terms of prayer clause (a') :- a.
That this Hon'ble Court be pleased to quash and set aside FIR No.113 of 2026 registered with Andheri Police Station, Mumbai filed under sections 406 and 420 of the Indian Penal Code, 1860 and after satisfying itself of the illegality of the same be pleased to quash and set aside the same as against the Applicant herein;

After having heard the matter for some time, Mr. Yogesh Rawool, learned Advocate for the Applicant, on instructions from the Applicant craves leave to withdraw the present Criminal Application with liberty Akash
4-CRI.APL-725-2026.doc to file an Application seeking discharge before the Trial Court at the appropriate stage. This request is not opposed by Ms. Rajeshree Newton, learned APP for the State.

In view of the statement made by Mr. Mr. Yogesh Rawool, learned Advocate for the Applicant and the no objection by Ms. Rajeshree Newton, leave is granted to withdraw the present Application with liberty as prayed.

If an Application seeking discharge is filed before the Trial Court at the appropriate stage, same be considered on its own merits and in accordance with law.
