Mr. Akshay Bankapur learned Advocate for the Respondent No.2 states that charge in Criminal Case bearing RCC No.1149 of 2024 pending on the file of CJM, Nashik was framed on 17th June 2025. He submits that the evidence in RCC No.1149 of 2024 has commenced and as a matter of fact, one witness has already been examined.

Mr. Rahul Shelke learned Advocate for the Applicants, confirms that the charge has been framed and one witness has been examined in RCC No.1149 of 2024. Mr. Rahul Shelke, learned Advocate for the Applicants, on instructions from the Applicants, seeks leave to withdraw the present Application with liberty to file appropriate proceedings before the appropriate Court to challenge the order framing the charge. 4.

Mr. Ameet Palkar learned APP for the Respondent-State and Mr. Akshay Bankapur learned Advocate for the Respondent No.2 do not object to the request for withdrawal of this Application but object to the grant of liberty. 5.

In view of the statement made by Mr. Rahul Shelke, learned Advocate for the Applicants, leave granted to withdraw this Application with liberty to file appropriate proceedings, if available in terms of law. All contentions of all the parties are expressly left open.
