By the present Application, the Applicant has sough for the following substantive relief in terms of prayer clause (B). "(B) Quash and set aside the F.I.R. bearing Crime No. 304/2022 dated 07.07.2022 registered with Sangavi Police Station, Pimpri Chinchwad, for the offences punishable under Sections 7, 7A and 12 of the Prevention of Corruption Act and Section 109 of the Indian Penal Code, and the consequential charge-sheet bearing No. 31/2024 dated Vivekanand

47-APL-960-2026.doc 05.04.2024 filed in Spl. Case No. 426/2026 pending before the learned Special Court, Pune, qua the present Applicant, and for that purpose issue necessary orders." 3.

Mr. Nitin Gaware Patil, learned Advocate for the Applicant, on instructions from the Applicant, seeks leave to withdraw the present Application with liberty to file an Application seeking discharge before the Trial Court at the appropriate stage. This request made by Mr. Nitin Gaware Patil, learned Advocate for the Applicant, is not opposed by Mr. Sukanta Karmakar, learned APP for the Respondent-State.

In view of the statement made by Mr. Nitin Gaware Patil, learned Advocate for the Applicant, leave is granted to withdraw the present Application with liberty as prayed. In the event, an Application seeking discharge is filed by the Applicant before the Trial Court at the appropriate stage, the same be considered on its own merits and in accordance with law.

Criminal Bail Application No. 960 of 2026 is disposed of as withdrawn.
