The Applicant is arrested in Crime Registration No.114 of 2024 registered with Jail Road Police Station, Solapur City for the offences punishable under Sections 302, 323 and 504 of the Indian Penal Code.
It is the case of prosecution that the Applicant initially went to the house of the deceased. He asked him to accompany him for consuming liquor. When he denied, he started abusing him in filthy language. Thereafter, he assaulted the wife of the deceased. When deceased intervened, he gave two kicks in his stomach. He fell down and thereafter, he died.

The counsel for Applicant has stated that the intention or motive was not there. It is in the spur of moment. It comes under Part II of Section 304 of the Indian Penal Code. As intention was not there, prayed to release the Applicant on bail. 4.
The learned APP opposed the application stating that the trial is already initiated. Three witnesses are already examined. The offence is under Section 302 of the Indian Penal Code. Hence, prayed to reject the application.

Heard learned counsel appearing for both the parties. 6.
As the offence is under Section 302 of the Indian Penal Code, the trial is already initiated and witnesses are examined, at this stage, the case is not made out to release the Applicant on bail. 7.
Hence, the Application is rejected.
