By this application, the applicant is seeking regular bail in Crime No. 400 of 2024 registered with Sinhagad Road Police Station, Pune under Sections 109(1), 111, 61(2) of BNS Act and under section 3(25),(27) of Arm Act and under section 37(1) (3)/135, 142 of MPA Act and under section 3(1) (ii), 3 (2), 3 (4), of MCOC Act. 2.

It is prosecution's case that on 11th July, 2024, the applicant fired at the feet of the first informant from his pistol with an intention to kill him. It is contention of the applicant that the injury is caused to left foot of the first informant. It is not on vital part. The applicant is behind the bars for more than one year and seven months. There is no progress in the trial and requested to allow the application.

It is the contention of the learned APP that the applicant has two antecedents. He fired from his pistol at the foot of the first informant. If the applicant is released on bail, he may abscond or threaten the prosecution witnesses and requested to reject the application. 4.

I have heard both learned counsel, perused the charge-sheet and the documents produced on record. The applicant is behind the bars for more than one year and seven months. There is no progress in the trial. The injury is caused to the leg of the first informant. Considering these facts, I pass the following order :

ORDER

(i) The applicant be enlarged on bail in Crime No. 400 of 2024 registered with Sinhagad Road Police Station, Pune on executing P.R.Bond in the sum of Rs.30,000/- with one or two sureties in the like amount.

(ii) The applicant shall attend the concerned police station as and when required.

(iii) The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

The application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
