The learned APP at the threshold submits that already 5 witnesses were examined and only five witnesses are yet to be examined as he has taken the instructions from his counterpart in the District Court. He further submits that entire trial would be concluded within 3 months.

Considering this fact, learned Counsel for the applicant, on instructions, seeks permission for withdrawal of the present application with liberty to approach this Court, if the trial is not concluded within three months, by filing fresh application for grant of bail on the ground of delay in rial.

Considering the statement made by the learned APP, the application stands disposed of as withdrawn with liberty as prayed for.

Trial Court is requested to conclude the trial within three months, from today.
