The Applicant has filed this application on the ground of delay in trial. The learned APP pointed out that the trial is already initiated and six witnesses are already examined. The nature of offence is gang rape.

After hearing the counsel appearing for both the parties, when this Court has shown disinclination to grant bail, the counsel for Applicant seeks permission to withdraw the application with liberty to file a fresh application before the trial Court, if there is change in circumstances. Permission granted.
