At the very outset, Ms. Poonam Bhosale, learned APP representing the State, drew my attention to the order passed by the Additional Sessions Judge, City Civil & Sessions Court, Greater Mumbai, in Criminal Bail Application No.3463/2025 in C.R. No.469 of 2024. In the said order the learned Judge has recorded that the trial has already commenced and one witness is under examination. It is also recorded that initially the Applicant failed to respond to two notices issued under Section 35(3) of the Bharatiya Nagarik 17th January 2026
Prasad Rajput (P.A.) 18_BA_114_2026.doc Suraksha Sanhita (BNSS) and that Applicant's history of evading process. Hence, at this stage, I am not inclined to consider allowing the application, since the trial has already commenced. Ms. Bhosale, on instructions, also states that there are as many as eight witnesses that the prosecution intends to examine.

In view of the statement made by Ms. Bhosale, Mr. Pathan, learned counsel for the Applicant, on instructions, seeks permission to withdraw the present Bail Application with liberty to file a fresh bail application after six months if the trial does not progress substantially. Permission is granted with the aforesaid liberty.

In any event, the Trial Court is requested to expedite the trial and conclude the same within a period of six months from the date on which this order is placed before it. 4.
