The Applicant is arrested in Crime Registration No. 461 of 2024 registered with Hatkanangale Police Station, Kolhapur for the offences punishable under Sections 103(2), 119(1), 126(2), 189(2), 189(4), 190, 191(1), 191(2), 191(3), 61(2) of the the Bharatiya Nyaya Sanhita, 2023 ('BNS').
The prosecution case is that on the complaint lodged by one Sandip Kamble, the crime came to be registered. The alleged incident took place on 16th August 2024 at about 2:30 p.m. The complainant other went to Kumar Vidya Mandir, Rui to meet the Applicant in order to resolve a past dispute. Thereafter, at about 1/3
9:15 p.m. the Applicant along with the other co-accused allegedly assaulted them with sticks, bamboos, stones, iron rod, sword and other sharp edged weapons.

Heard learned counsel appearing for both the parties. 6.
The Applicant herein is claiming the parity as the co-accused Sachin Shinde is released on bail by this Court and the role attributed to this Applicant is similar to the co-accused Sachin Shinde. The allegations made against this Applicant that he had assaulted one of the injured with bamboo stick. On perusal of injury certificate, it appears that it is simple injury. The allegations are not about assaulting the deceased. As the parity is applicable, the case is made out to release the Applicant on bail.

Hence, the Application is allowed on the following terms and conditions :
i) The Applicant, namely, Ritesh Mohan Sathe shall be 2/3
released on bail on furnishing personal bond of Rs.25,000/- with his recent self-attested photograph and surety of the like amount on the following conditions at the satisfaction of the investigating officer;
ii) The Applicant shall not directly or indirectly make any inducement, threat or promise to any witness acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer; iii) The Applicant shall not obstruct or hamper the police investigation and not to play mischief with the evidence collected or yet to be collected by the police; iv) The Applicant shall maintain law and order;
v) The Applicant shall, at the time of execution of the bond, furnish his address and mobile number to the investigating officer, and the court concerned, and shall not change the residence till the final disposal of the case; vi) The Applicant shall regularly remain present during the trial, and cooperate with the learned trial Court to complete the trial for the above offences.
