The learned counsel for applicant submits that, he has filed the present application mainly on the ground of 'delay in trial'. This Court by its order dated 27.02.2026 has called the report from the District Judge-18 and Additional Sessions Judge Nagpur in respect of the status of the trial. The status report is received wherein it is stated that already seven witnesses are examined. On this, the learned APP on instructions, submits that there are hardly five to six witnesses remained to be examined and trial that would be completed within one or two months. 3.

In view above, the learned counsel for the applicant seeks withdrawal of the application with liberty to file a fresh application before this Court, in case the trial is not concluded within two months. He further submits

Permission granted.

Application stands disposed of with liberty as prayed for.
