Applicant seeks regular bail in connection with Crime No. 428 of 2025 registered with Mira Road Police Station, MiraBhayender, Vasai-Virar for the offences punishable under Sections 143(3), 3(5) of the Bhartiya Nyaya Sanhita, 2023 (For short "BNS Act") and under Sections 3, 4 and 5 of Immoral Traffic (Prevention) Act, 1956.

It is the case of the prosecution that the Applicant lured the victims on false promise of offering job and got prostitution done from them. It is also alleged that present Applicant received money from the said prostitution work and hence committed offence. After filing of the charesheet, Applicant came to be arrested in September-2025 and thereafter on conclusion of investigation chargesheet has been filed.

Learned Counsel for the Applicant submits that Applicant has no criminal history and that he cannot be kept in jail by way of pretrial sentence. It is also contended that alleged victim of the crime are adult women and having regard to the allegations against Applicant, there is no reason to keep him behind bars. 4.

Learned APP opposes Application by citing serious nature of crime. It is her contention that if, he is release on bail, Applicant is likely to commit similar offence. 5.

There is no dispute about the fact that the victims in the present case are major. Now after conclusion of investigation chargesheet has been filed, hence there is no propriety to keep him in jail. There is no criminal antecedents against the Applicant leave a part similar nature of crime to be committed in the past. This Court finds substance in the contention of Counsel for the Applicant that he cannot be kept behind bars by way of pretrial sentence. Hence, order.

ORDER

i) Criminal Bail Application stands allowed in connection with Crime No. 428 of 2025 registered with Mira Road Police Station, Mira-Bhayender, Vasai-Virar for the offences punishable under Sections 143(3), 3(5) of the Bhartiya Nyaya Sanhita, 2023 and under Sections 3, 4 and 5 of Immoral Traffic (Prevention) Act, 1956.

ii) Applicant be enlarged on bail, on furnishing P. R. Bond of Rs.15,000/- with one surety in the like amount, till the satisfaction of the Trial Court.

iii) Applicant is directed not to contact victim or any prosecution witnesses, in any manner, whatsoever.

iv) Applicant to attend all dates of hearing before the Trail Court unless his presence is exempted by passing specific order.

v) Applicant shall not involved in similar or any crime, during the trial.

vi) Any breach of the above condition shall result forthwith in cancellation of bail.

The application is allowed in aforesaid terms and is accordingly disposed of.

It is clarified that the above observations are made on prima facie consideration of the material on record and the same shall not bind the parties during the trial. 8.

All concerned to act upon the authenticated copy of this order.
