Heard learned counsel for the Applicant, learned APP for the State.

By this Application, the Applicant is seeking regular bail in Crime No. I-440 of 2024 registered with Lonikalbhor Police Station, Dist. Pune for the offences punishable under Sections 111. 112, 303(2), 61(2), 316(3), 287, 288 of Bhartiya Nyay Sanhita, 2023 and Sections 4,5,6 of Explosive Substances Act and Sections 3 & 7 of Essential Commodities Act. 3.

It is prosecution's case that Applicant and co-accused stolen the diesel from the tanker of petrol company.

It is contention of learned counsel for the Applicant that the coaccused who were arrested on the spot, have been released on bail by this

Court. Hence, Applicant is entitled for bail on principle of parity. Applicant is behind bars more than one year and five months and requested to allow the Application.

It is contention of learned APP that Applicant is the main culprit. The persons who were arrested on the spot were servants of the Applicant. The Applicant has antecedents. If Applicant released on bail, he may abscond or threaten the prosecution witnesses and requested to reject the Application. Charge is framed.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The co-accused, having similar allegations,have been released on bail. Hence, Applicant is entitled for bail on principle of parity. 8.

Considering these facts, I pass following order.

ORDER

(i) The Applicant- Shrikant @ Sonay Rajendra Sumbe be released on bail in Crime No. I-440 of 2024 registered with Lonikalbhor Police Station, Dist. Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in

accordance with law, uninfluenced by the observations made in this order. (iv) The Applicant shall attend the concerned Police Station as and when required.

(v ) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
