The applicant seeks regular bail in connection with C.R. No. 284 of 2022 dated 25.09.2022 registered with Shahapur Police Station, Ichalkaranji District Kolhapur for the offences punishable under Sections 307, 324, 326, 143, 147, 149, 506 of the Indian Penal Code and Sections.

Learned Counsel for the applicant submits that the applicant has been falsely implicated in the case. The applicant is in custody since his arrest on 25.09.2022, i.e. for more than three years and six months. Investigation is complete and the charge-sheet is filed. Court and the Hon'ble Apex Court respectively. The trial is unlikely to conclude within a reasonable period. As such, further incarceration of the applicant is unjustified. Hence, prayed to allow the application.

Per contra, learned APP opposed the application submitting that the offence is serious in nature. The role of the present applicant is distinct than that of the co-accused enlarged on bail. The applicant had prior dispute with the informant and her son. As such, there is motive on the part of the applicant. Hence, prayed to reject the application.

Upon considering submissions of both sides and perusal of the material on record, including charge-sheet, prima facie it appears that the injured was a son of the informant. In the said assault, the informant also sustained certain injuries along with her husband/witness. However, the injured are discharged by the concerned the hospital.

Further perusal of the allegations indicate that there are general allegations against the applicant indicating no specific role. The co-accused are already enlarged on bail this Court as well as the Hon'ble Apex Court. Given the prolonged detention of the applicant 2 of

for more than three years and six months coupled with the fact that the trial is likely to take a considerable time to conclude, I am persuaded to exercise discretion in favour of the applicant. 7.

Hence, the order :-

O R D E R

I.

The bail application is allowed.

II.

Applicant - Shubham Ramesh Mane be released on bail, on furnishing P.R. bond in the sum of Rs.50,000/- (Rs.Fifty Thousand) with one or two local solvent sureties, in the like amount, in connection with C.R. No. 284 of 2022 dated 25.09.2022 registered with Shahapur Police Station, Ichalkaranji District Kolhapur for the offences punishable under Sections 307, 324, 326, 143, 147, 149, 506 of the Indian Penal Code and Sections, on the following conditions :- (a) The applicant shall not pressurize the prosecution witnesses and tamper with the prosecution evidence, in any manner.

(b) The applicant shall attend the trial on each and every date unless exempted by the trial Court. (c) The applicant shall submit Aadhar and Pan Cards to the Investigating Officer and detailed address and phone numbers and two of the near relatives.

(d) In case of breach of any of the conditions by the applicant, it is open for the Prosecution to approach the concerned Court seeking cancellation of bail, notwithstanding the fact that this Court has granted bail. III.

Needless to state that the observations rendered herein are to the extent of this application and the trial Court shall not be influenced by the same.
