Heard learned counsel for the Applicant and Learned APP for State.

By this Application, the Applicant is seeking regular bail in Crime No.689 of 2023 dated 12/10/2023 registered with Ranjangaon MIDC Police Station, Pune for the offences punishable under Section 302 of the Indian Penal Code, 1860.

It is prosecution's case on 5/10/2023, Applicant assaulted with cement block on head of the deceased and murdered him on the ground of old dispute. nt.

It is contention of learned counsel for the Applicant that incident happened out of sudden quarrel. Applicant had no intention to kill the deceased. Applicant has no antecedents. He is behind bars more
than two years and five months. There is no progress in the trial and requested to allow the Application.

It is contention of learned APP that Applicant and deceased had dispute before the actual incident. Applicant intentionally assaulted on the head of deceased with cement block. Applicant had intention to kill the deceased and if Applicant released on bail, he may abscond and requested to reject the Application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

It appears from the FIR that incident occurred in spur of moment and Applicant assaulted on head of the deceased with cement block lying near the incident spot. To prove intention of the Applicant to kill the deceased or not is part of trial. Applicant has no antecedents. He is behind bars more than two years. There is no progress in the trial. 7.
Considering these facts, I pass following order.
ORDER
(i) The Applicant-Waman Baban Chaughule, be released on bail in Crime No.689 of 2023 dated 12/10/2023 registered with Ranjangaon MIDC Police Station, Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.
(ii) Applicant shall not enter in the jurisdiction of Ranjangaon MIDC Police Staion till recording of evidence of the First Informant. (iii) The Applicant is directed to provide his new residential address after he is released on bail and contact number to the Investigating Officer. (iv) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(v) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (vi) The Applicant shall attend the concerned Police Station as and when required.
(vii) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
