By this application, the applicant is seeking bail in connection with Crime No.262/2024 registered with Police Station Ajni, Dist. Nagpur for the offence punishable under Sections 302, 143, 147, 148, 149 and 120(B) of the Indian Penal Code, Sections 4, 25 of the Arms Act, Section 135 of the Maharashtra Police Act and Section 3(1)(ii), 3(2), 3(4) of the Maharashtra Control of Organised Crime Act, 1999. 3.

Brief facts of the prosecution story are that the informant namely, Sureshrao Udaramji Mehar has lodged report on 26.04.2024 alleging that, on 25.04.2024 around 11:00 pm, his son Amol Mehär was assaulted at Hasarapeth Lane in front of Mangesh Hatagade's house by the accused Rajat Lalla Sharma, Kartik Sharma

2 25 BA 186.26 (Applicant), Nitin Maske, Sunayan Kharche and others with sharp edged weapons like iron knife, sword etc., thereby, seriously injuring him to which he succumbed owing to some previous dispute. On the basis of their allegations, the FIR was registered.

This Court by an order dated 19.01.2026 in Criminal Application (BA) No. 1228/2025 granted bail to one of the accused namely Ritik S/o. Raju Shelkar. Further, this Court has also granted bail to one Aniket Diliprao Kale in Criminal Application (BA) No. 1304/ 2025 by an order dated 21/01/2026. The learned counsel submits that the present applicant is also standing on the same footing, therefore, for the reasons set out in Criminal Application No.1228/2025 in the case of Ritik Raju Shelkar, the present applicant be released on bail. 5.

On the other hand, the learned APP vehemently opposes the application and submits that so far as the present applicant is concerned, he is having criminal history. An offence under Section 302 of the Indian Penal Code was registered against him. However, he submits that he was acquitted from that offence. Considering the

3 25 BA 186.26 fact that the applicant is having antecedents, the applicant may not be released on bail.

I have considered the rival submissions. This court has already granted bail to Ritik Shelkar and Aniket Kale. It appears from the allegations that the applicant is also standing on the same footing, therefore, on the ground of parity, the applicant deserves to be released on bail. No doubt, there are other offences which are registered against the applicant. However, so far as Crime No. 328/2013 which is registered under Section 302 of IPC is concerned, the applicant was already acquitted in the year 2015 itself and even in most of the other cases, he was acquitted. Considering the fact that this Court has already released on bail other similarly situated accused, I am inclined to grant bail on the ground of parity for the reasons recorded in the Criminal Application No.1228/2025, hence the following order:-

ORDER

(i) Criminal application is allowed and disposed of. (ii) The applicant/accused Kartik S/o. Ashok Sharma be released on regular bail in connection with Crime No.262/2024 registered with Police Station Ajni, Dist.

4 25 BA 186.26 Nagpur for the offence punishable under Sections 302, 143, 147, 148, 149 and 120(B) of the Indian Penal Code, Sections 4, 25 of the Arms Act, Section 135 of the Maharashtra Police Act and Section 3(1)(ii), 3(2), 3(4) of the Maharashtra Control of Organised Crime Act, 1999 on his furnishing P.R. Bond of Rs. 25,000/- with one surety in the like amount.

(iii) The accused shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence.

(iv) The accused shall provide his residential address and cell number to concerned Police Station and shall not change his place of residence without prior intimation to the concerned Investigating Officer.

(v) The applicant/accused shall attend each and every date of trial regularly. If he fails to attend the trial for two consecutive dates or fails to comply with the aforesaid conditions, his default would entail the State to ask for cancellation of bail.
