The present application is filed seeking regular bail in Crime No.654/2025 for the offence punishable under Sections 387, 342, 294, 506, 120-B and 326 of the Indian Penal Code, 1860, Sections 39 and 44 of the Maharashtra Money Lending (Regulation) Act, Sections 143 (1)(a)(f) and 143(2) of the Bharatiya Nyaya Sanhita, 2023, and Sections 18 and 19 of the Transplantation of Human Organs and Tissues Act, 1994, registered with Police Station Bramhapuri, District Chandrapur.

This Court, has already granted bail to three accused persons for the same crime. The present applicant is also standing on the same footing. The counsel for the applicant submits that
the applicant deserve to be granted bail on the ground of parity.

The learned A.P.P. has conceded the fact that the accused persons who have been granted bail by this Court are similarly situated to the present applicant. The only difference is that the informant had taken loan from the present applicant of Rs.90,000/- and the informant has repaid Rs.3,60,000/- with interest. Only figure of amount differs. The applicant was arrested on 17/12/2025. Therefore, for the reasons recorded in the order dated 26/02/2026 in the case of Pradip S/o Rambhau Bawankule, Criminal Application [B.A.] No.175/2026 and order dated 12/02/2026, in the case of Laxman Pundalik Urkude, in Criminal Application [B.A.] No.92/2026. I am also inclined to grant bail to the present applicant on imposing same terms and conditions. Hence, the following order:-
O R D E R
(i) The Criminal Application is allowed;
(ii) The applicant/accused (Satyavan Ramratan Borkar) be released on regular bail in connection with Crime No.654/2025 for the offence punishable under Sections 387, 342, 294, 506, 120-B and 326 of the Indian Penal Code, 1860, Sections 39 and 44 of the
Maharashtra Money Lending (Regulation) Act, Sections 143 (1)(a)(f) and 143(2) of the Bharatiya Nyaya Sanhita, 2023, and Sections 18 and 19 of the Transplantation of Human Organs and Tissues Act, 1994, registered with Police Station Bramhapuri, District Chandrapur, on his furnishing a P.R. bond of Rs.25,000/- (Twenty Five Thousand Rupees) with one solvent surety in the like amount;
(iii) The accused shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence;
(iv) The accused shall provide his residential address and cell number to Police Station concerned and shall not change his place of residence without prior intimation to the Investigating Agency;
(v) The accused shall attend each and every date of trial regularly. If he fails to attend the trial for two consecutive dates, or fails to comply with the aforesaid conditions, his default would entail the State to ask for cancellation of bail or even trial Court suo moto take cognizance of this and cancel the bail;
(vi) Pending Misc. Application(s), if any, also stand disposed of.

The observations of this Court are prima facie in nature. The Trial Court shall not be influenced by the observations of this Court and the observations are restricted to this bail application only.
