By this Application, the Applicant is seeking regular bail in Crime No.343 of 2022 registered with Waraje Malwadi Police Station, Pune for the offences punishable under Sections 302, 397 and 452 of the Indian Penal Code, 1860 ('IPC' for short).

It is prosecution's case that on 13th September 2022, at around 4.30 p.m., the Applicant murdered her grand-mother and stole the gold ornaments and amount from the house.

It is contention of learned counsel for the Applicant that the Applicant is behind bars for more than three years and five months. She is

lady. She is suffering from chronic psorotic arthritis and other ailments. The Applicant has no antecedents. There is no progress in trial, and requested to allow the Application.

It is contention of learned APP that the Applicant filed false complaint against the unknown person to distract the police from investigation stating that unknown person murdered her grand-mother. But in investigation it is revealed that the Applicant has murdered her grand-mother and has stolen gold ornaments and amounts from the house. The ornaments are recovered from the jwellery shop. The CCTV footage shows the presence of the Applicant at the incident spot. There were 34 injuries on the body of the deceased. If the Applicant released on bail, she may abscond or threaten prosecution witnesses, and requested to reject the Application. 5.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The Applicant is behind bars for more than three years and five months. The Applicant has no antecedents. There is no progress in trial. She is lady. She is suffering from from chronic psorotic arthritis and other ailments. 7.

Considering these facts, I pass following order.

ORDER

(i) The Applicant-Gauri Sunil Dange be released on bail in Crime No.343 of 2022 registered with Waraje Malwadi Police

Station, Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.

(iv) The Applicant shall attend the concerned Police Station as and when required.

(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
