The applicant seeks regular bail in connection with Crime Register No.461 of 2024 dated 17.08.2024 registered with Hatkanangale Police Station, District Kolhapur for offences punishable under Sections 103(2), 119(1), 126(2), 189(2), 189(4), 190, 191(1), 191(2), 191(3), 61(2) of the Bharatiya Nyaya Sanhita, 2023.

Learned Counsel for the applicant submits that the applicant has been falsely implicated in the alleged crime. The co-accused, are enlarged on bail by this Court in Bail Application Nos.37/2026, Digitally signed by SAJAKALI LIYAKAT JAMADAR Date:

98/2026, 44/2026, 125/2026. The applicant being on similar footing is also entitled for parity. Hence, prayed to allow the application.

Per contra, learned APP opposed the application submitting that the applicant has instigated the other co-accused and was present at the spot. Hence, prayed to reject the application. 4.
Having heard the submissions from both the sides and upon perusal of the record including charge-sheet prima facie indicates that the role attributed to the present Applicant is limited to instigation of the other accused to kill the deceased. It is noted that the co-accused having similar role have already been released on bail. Having regard to the number of witnesses, the trial is unlikely to conclude within a reasonable period. In view of principles of parity, application warrants consideration.

Hence, the order :-
O R D E R
I.
The bail application is allowed.
II.
Applicant - Nilesh Anil Sathe be released on bail, on furnishing P.R. bond in the sum of Rs.50,000/- (Rs.Fifty 2 of
Thousand) with one or two local solvent sureties, in the like amount, in connection with Crime Register No.461 of 2024 dated 17.08.2024 registered with Hatkanangale Police Station, District Kolhapur for offences punishable under Sections 103(2), 119(1), 126(2), 189(2), 189(4), 190, 191(1), 191(2), 191(3), 61(2) of the Bharatiya Nyaya Sanhita, 2023, on the following conditions :- (a) The applicant shall report the Hatkanangale Police Station, District Kolhapur on first Monday of every month between 10.00 a.m. to 12.00 noon, until further orders. (b) The Applicant shall not directly or indirectly make any inducement, threat or promise to any witness acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer.
(c) The applicant shall appear before the Trial Court on every date of hearing unless prevented by sufficient cause.
d) The applicant shall not leave the territorial jurisdiction of the Trial Court without prior permission.
e) The applicant shall not indulge in any criminal activity during the pendency of the trial.

f) Any breach of these conditions shall result in the prosecution moving for cancellation of bail before the Trial Court.
III.
Needless to state that the observations rendered herein are to the extent of this application and the trial Court shall not be influenced by the same.
