By way of this application the applicant is seeking bail in connection with Crime No.578 of 2023 registered with the Mehkar Police Station, District Buldhana for the offence punishable under Sections 8(c), 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

It appears that evidence is started before the Trial Court and few witnesses have been examined. Witness No.3 P.S.I. Shrikant Jindamwar was examined however, his cross-examination is yet to be completed. It appears that though summons was issued to P.S.I. Shrikant Jindamwar from time to time, he was not present before the Trial Court for cross-examination. On 10.02.2026, the application for adjournment was filed by witness no.3, which came to be allowed. Thereafter again summons was issued, however he has not appeared and further from Roznama it appears that on 17.03.2026 non-bailable warrant was issued against him. It appears that witness no.3 is the Police Officer. It is his

2 23.ba.247.2026 duty to attend the Court promptly, however he chooses to remain absent before the Court. And therefore, due to absence of the witness no. 3 P.S.I. Shrikant Jindamwar, the trial is hampered and prolonged.

It is informed that witness no. 3 P.S.I. Shrikant Jindamwar is presently posted within the jurisdiction of Amravati (rural). Therefore, the Superintendent of Police, Amravati (Rural) is hereby directed to file the report in this regard explaining that why the witness no.3 P.S.I. Shrikant Jindamwar is not attending the trial court proceeding promptly.

Learned APP shall communicate this order to the concerned Superintendent of Police and seek immediate response from him.
