By way of this application, the applicant is seeking bail in connection with Crime No.31 of 2026 registered with Umerkhed Police Station, District Yavatmal for the offence punishable under Section 135 of the Maharashtra Police Act, Sections 109(1), 296, 126(2), 351(3), 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023.

The FIR came to be lodged by one Sudhakar Rathod alleging that on 17.01.2026 at about 5.30 p.m. one Sheikh Ibrahim abused and assaulted the informant/victim when he asked him to have a side from road with iron road and when informant tried to run he took out sword like weapon and assaulted the victim. It is also alleged that the present applicant and co-accused have also assaulted two more ladies by means of stone and wooden stick.

Learned Counsel for the applicant submits that the present applicant assaulted other two ladies, who were present at the relevant time. There was no assault
2 32.ba.270.2026 at the hands of the present applicant to the informant. Only to rescue her brother she assaulted other two ladies with the help of stone and wooden stick, however their medical report shows that the injury is simple nature. Learned Counsel for the applicant submits that very limited role is attributed to the applicant in the present crime. The applicant is in jail since 18.01.2026 and the applicant being a lady, she may be enlarged on bail. 5.
On the other hand the learned APP vehemently opposed the application stating that the applicant has played an active role in the crime along with the main accused namely Sheikh Imran @ Ibrahim. The applicant is the real sister of main accused. Specific role has been attributed to the applicant that while main accused Sheikh Imran @ Ibrahim assaulted the informant at that time the applicant came there to help the accused and she inflicted blow on other two ladies with the help of stone and wooden stick. Since the investigation is not complete and charge-sheet is yet to be filed, the applicant may not be released on bail.

I have considered the rival submission. It appears that the applicant is the real sister of the main accused. The main accused assaulted the informant and inflicted blow on the head with the help of weapon like iron road. The role attributed to the applicant is very limited as FIR shows that the applicant assaulted two women with the stone and stick however she did not assault the informant. As the applicant is in jail since 18.01.2026 and considering the limited role played by the applicant and she being a woman, I am inclined to
3 32.ba.270.2026 enlarge the applicant on bail, on certain terms and conditions though the investigation is not complete. Hence the following order :
(a) The application is allowed.
(b) The applicant Jarinabi Sheikh Ibrahim in connection with Crime No.31 of 2026 registered with Umerkhed Police Station, District Yavatmal be released on bail on furnishing P.R. bond of Rs.50,000/- with one or two sureties in the like amount.
(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence.
(d) The accused shall provide her residential address and cell number to Police Station concerned and shall not change her place of residence without prior intimation to the Investigating Agency.
(e) The applicant shall not commit any similar type of offence.
(f) The accused shall attend each and every date of trial regularly. If she fails to attend the trial for two consecutive dates, or fails to comply with the aforesaid conditions, her default
4 32.ba.270.2026 would entail the State to ask for cancellation of bail.

The observations are prima facie in nature and the Trial Court shall not be influenced by the same . 8.
All Misc. application(s), pending if any, shall stands disposed of accordingly.
