By this application, the applicant is seeking bail in connection with Crime No.471/2025 registered with Police Station Jaripatka, Dist. Nagpur for the offence punishable under Sections 103(1), 189(1), 189(2) and 190 of the Bharatiya Nyaya Sanhita, 2023.

This Court vide order dated 16/01/2026 passed in Criminal Application (BA) No. 1415/2025 released one accused namely Bhupendra Surendra Banjare. So far as the role played by the said accused Bhupendra Banjare is concerned, he was present on the spot and from the CCTV footage, it is clear that he has given fist and kick blows and other accused persons namely Sujal @ Ammy Mhaiskar and Abhishek @ Abhi Ganesh Ambade assaulted deceased with the help of stone on the head. There are total 13
2 30 BA 287.26 injuries on the person of the deceased. However, the cause of death in the postmortem report is shown as head injury and that injury is attributed to Sujal @ Ammy Mhaiskar and Abhishek @ Abhi Ganesh Ambade who have assaulted the deceased on the head with stone. Therefore the role played by the present applicant and Bhupendra Banjare who has been released by this Court on bail appears to be similar in nature. The only difference is that the applicant is having criminal antecedents. Crime No.242/ 2024 was registered against the applicant under section 4 and 25 of the Arms Act etc. as well as Crime No. 450/2024 was registered under section 307, 324 of the Indian Penal Code etc.

I am conscious of the fact that there are criminal antecedents, however considering the fact that limited role is played by the applicant in the entire episode and for the reasons stated in the order dated 16/01/2026 passed in Criminal Application (BA) No. 1415/2025, I am inclined to grant bail to the present applicant on the ground of parity, hence the following order:-

ORDER
(i) Criminal application is allowed and disposed of. (ii) The applicant/accused Sarthak @ Sujal @ Sindhi S/o Rajesh Chavan be released on bail in connection with Crime No.471/2025 registered with Police Station Jaripatka, Dist. Nagpur for the offence punishable under Sections 103(1), 189(1), 189(2) and 190 of the Bharatiya Nyaya Sanhita, 2023 on his furnishing P.R. Bond of Rs. 25,000/- with one surety in the like amount.
(iii) The accused shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence.
(iv) The accused shall provide his residential address and cell number to concerned Police Station and shall not change his place of residence without prior intimation to the concerned Investigating Officer.
(v) The applicant/accused shall attend each and every date of trial regularly. If he fails to attend the trial for two consecutive dates or fails to comply with the aforesaid conditions, his default would entail the State to ask for cancellation of bail.
