Heard learned counsel for the Applicant, learned APP for the State and learned counsel for Respondent No.2. 2.

By this Application, the Applicant is seeking regular bail in Crime No. 78/2024 dated 29/06/2024 registered with Deolali Camp Police Station, Dist. Nashik for the offences punishable under Sections 376, 376(2) (n), 376(2) (f) of the Indian Penal Code, 1860 and under Sections 4,6 and 12 of the Prevention of Children from Sexual Offences Act, 2012.

It is prosecution's case that Applicant sexually assaulted the first informant on several occasions by threatening her. It is alleged that Applicant is brother in law of the first informant.

It is contention of learned counsel for the Applicant that Applicant is behind bars more than two years. The relations between the Applicant and victim was consensual. The evidence of the first informant is recorded, she has turned hostile and requested to allow the Application. 5.

It is contention of learned APP that if Applicant released on bail, he may abscond and requested to reject the Application. 6.

It is contention of learned counsel for Respondent No.2 that Respondent No.2 has no objection to allow the bail application. 7.

I have heard all learned counsel. Perused charge-sheet and documents produced on record.

There is delay in lodging the complaint. The evidence of the first informant is recorded before the trial Court, she has turned hostile. Applicant is behind bars more than 2 years.

Considering these facts, I pass following order.

ORDER

(i) The Applicant-Parvej Raju Shaikh be released on bail in Crime No. 78/2024 dated 29/06/2024 registered with Deolali Camp Police Station, Dist. Nashik, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (iv) The Applicant shall attend the concerned Police Station as and when required.

(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
