Heard learned counsel for the Applicant and learned APP for the State.

By this Application, the Applicant is seeking regular bail in Crime No. 463 of 204 registered with Dindori Police Station, Dist. Nashik for the offences punishable under Sections 103(1) 238, 3(5) of Bharatiya Nyaya Sanhita.

It is prosecution's case that in between 23/11/2024 at 06.00 pm to 24/11/2024 at 12.00 hrs, the Applicant and co-accused murdered the deceased by assaulting him with sharp weapon. 4.

It is contention of learned counsel for the Applicant that coaccused Akshay Subhash Kuvar, against whom similar allegations are

leveled, has been released on bail by this Court [Coram: Ashwin Bhobe, J.] by order dated 12/12/2025 and hence, applicant is entitled for bail on principle of parity and requested to allow the application. 5.

It is contention of learned APP that principle of parity will not be applicable as allegations against the Applicant are serious. If Applicant is released on bail, he may abscond or threaten the prosecution witnesses and requested to reject the application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The allegations against the Applicant are similar to the allegations against the co-accused Akshay Subhash Kuvar, who has been released on bail by this Court. Hence, Applicant is entitled for bail on principle of party.

Considering these facts, I pass following order.

ORDER

(i) The Applicant- Mangesh Raju Pawade be released on bail in Crime No. 463 of 204 registered with Dindori Police Station, Dist. Nashik, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (iv) The Applicant shall attend the concerned Police Station as and when required.

(v) Bail Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
