Heard learned counsel for the Applicant and learned APP for the State.

Learned APP tenders affidavit in reply. It is taken on record.. 3.

By this application, applicant is seeking regular bail in Crime No. 122 of 2018 registered with Mangaon Police Station for the offence punishable under Sections 394, 341, 504 r/w.34 of Indian Penal Code (for short 'IPC') and Sections 3(1)(ii), 3(2), 3(4) of the Maharashtra Control of Organized Crimes Act, 1999.

It is prosecution's case that on 07/07/2018, Applicant and coaccused intercepted the vehicle of first informant and by assaulting him, robbed amount of Rs.640/- and mobile of the first informant.

It is contention of learned counsel for the Applicant that Applicant is behind bars around eight years. There is no progress in the trial. The co-accused having similar allegations, have been released on bail and requested to allow the application.

It is contention of learned APP that Applicant is the gang leader and he has five antecedents of similar nature. If he released on bail, he may abscond or threaten prosecution witnesses. The trial is in progress and twelve witnesses have been examined and requested to reject the application.

I have heard both learned counsel. Perused the charge-sheet and documents produced on record.

Applicant is behind bars around eight years, yet trial is not concluded. The co-accused having similar allegations, have been released on bail.

Considering these facts, I pass following order:

ORDER

(i) The Applicant-Sachin Shrirang Chavan be released on bail in Crime No. 122 of 2018 registered with Mangaon Police Station, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or

influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (iv) The Applicant shall attend the concerned Police Station as and when required.
