By this Application, the Applicant is seeking regular bail in Crime No.786 of 2025 registered with Hinjewadi Police Station, Pimpri Chinchwad, Pune, for the offences punishable under Sections 105, 281, 324(4) of the Bharatiya Nyaya Sanhita, 2023 ('BNS' for short) and Sections 119, 134(A), 134(B), 177, 184 of the Motor Vehicles Act, 1988. 2.
It is prosecution's case that on 10th October 2025, around 11.30 a.m. the Applicant drove RMC Mixture vehicle rashly and negligently and gave dash to wife of First Informant causing her death. It is alleged at the time of the accident, entry of the mixer vehicle was not permitted in the said area.

It is contention of learned counsel for the Applicant that the Applicant is behind bars for more than six months. The Applicant has no antecedents. The investigation is completed and charge-sheet has been filed, and requested to allow the Application.

It is contention of learned APP that, the Applicant was aware that the road on which accident occurred was prohibited for driving mixer vehicle inspite of that the Applicant drove the vehicle gave dash to the motorcycle of the deceased and caused her death. If the Applicant released on bail, he may abscond or threaten prosecution witnesses, and requested to reject the Application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The Applicant is behind bars for more than six months. The Applicant has no antecedents. There is no progress in trial. It may take time to conclude the trial. Considering allegations against the Applicant, I pass following order.
ORDER
(i) The Applicant be released on bail in No.786 of 2025 registered with Hinjewadi Police Station, Pimpri Chinchwad,
Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.
(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.
(iv) The Applicant shall attend the concerned Police Station as and when required.
(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
