Sections 109, 189(2), 189(4), 191(2), 191(3), 190, 352, 351(2), 238 & 324(4) of the Bhartiya Nyay Sanhita, 2023. 2.
Learned Counsel for the applicants submits that applicants are falsely implicated in the case. The Investigation is complete and the charge-sheet is filed. It is further submitted that except the present applicants all the co-accused are enlarged on bail by this Court. Hence, prayed to allow the application on the ground of parity. 3.
Per contra, learned APP opposed the application submitting that the offence is serious in nature. Further, an apprehension is also expressed that if the applicants are enlarged on bail, there is every possibility of tampering prosecution witnesses. Hence, prayed to reject the application.

Having heard the submissions from both the sides and upon perusal of the record indicates that omnibus allegations are levelled against all the accused. The veracity and reliability of the C.C.T.V. footage indicating the complicity of the present applicant can be adequately dealt in detail during the trial. The co-accused having similar allegations have been admitted to bail by this Court as well as the trial Court. Hence, the applicants are entitled for bail, on the ground of principle of parity.

As far as the apprehension expressed by the learned A.P.P. in relation to tampering prosecution witnesses is concerned, the same can be adequately taken care of by imposing stringent conditions. I am, therefore, persuaded to exercise the discretion in favour of the applicants.

Hence, the order :-
O R D E R
I.
The bail application is allowed.
II.
applicants - Durvankar Jayant Kharkande, Prajwal Ashok Haladkar and Amarnath Alias Vishwanath Machindra Jadhav be released on bail, on furnishing P.R. bond in the sum of Rs.50,000/- (Rs.Fifty Thousand) each with one or two local solvent sureties, in the like amount, in connection with Crime No. 378 of 2025 registered with Shivajinagar Police Station, Ichalkaranji, District Kolhapur for offences punishable under Sections 109, 189(2), 189(4), 191(2), 191(3), 190, 352, 351(2), 238 & 324(4) of the Bhartiya Nyay Sanhita, 2023, on the following conditions :- (a) The applicants shall not pressurize the prosecution witnesses and tamper with the prosecution evidence, in any manner.
(b) The applicants shall attend the trial on each and every date unless exempted by the trial Court. 3 of
(c) The applicants shall submit Aadhar and Pan Cards to the Investigating Officer and detailed address and phone numbers and two of the near relatives.
(d) In case of breach of any of the conditions by the applicants, it is open for the Prosecution to approach the concerned Court seeking cancellation of bail, notwithstanding the fact that this Court has granted bail. III.
Needless to state that the observations rendered herein are to the extent of this application and the trial Court shall not be influenced by the same.
