By this Application, the Applicant is seeking regular bail in Crime No.178 of 2025 registered with Hinjewadi Police Station, Pune, for the offences punishable under Sections 143(3), 143(4), 3(5) of the Bharatiya Nyaya Sanhita, 2023 ('BNS' for short), Sections 3,4,5 and 7 of the Immoral Trafficking (Prevention) Act, 1956 and Section 14 of the Protection of Children from Sexual Offences Act, ('POCSO' for short). 2.
It is prosecution's case that on secret information, Police conducted raid at Aatithi Lodging and Boarding, Wakhad and found that prostitution was going there. It is alleged that the Applicant was Manager of the said lodge and he was providing rooms for prostitution by taking
amount. Learned counsel further submitted that the statement of victims have been recorded and they have not uttered any word against the applicant and requested to allow the application. 3.
It is contention of learned APP that, the Applicant has one antecedent. He was providing room for prostitution in lieu of amount. It shows his involvement in crime. If Applicant is released on bail, he may abscond or threaten prosecution witnesses. Hence, requested to reject the Application.

I have heard both learned counsel. Perused chargesheet and documents produced on record. Investigation is completed. Chargesheet has been filed. The applicant is behind bars for more than 10 months. The co-accused owner of the lodge has been released on bail by this Court. Hence, the applicant is entitled for bail on principle of parity. Considering these facts, I pass following order.
ORDER
i.
The applicant be enlarged on bail in Crime No.178 of 2025 registered with Hinjewadi Police Station, Pune, on executing P.R.Bond of Rs. 30,000/- on furnishing one or two sureties in the like amount.
ii.
The applicant shall attend the concerned police station as and when required.
iii.
The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case. 5.
The application is allowed in the aforesaid terms and is accordingly disposed of. All pending applications, if any, disposed of. 6.
It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
