It appears that the application has been filed by the applicant for grant of bail on the ground of delay in trial. Admittedly, the applicant is behind bars since 16/07/2021. Since the trial is not concluded till today, this Court called the status report. It appears from the status report that the wife of the applicant after release on bail is absconding. It appears from the status report that the applicant has changed four Advocates and now fifth advocate is engaged from the panel of legal aid. The status report further shows that though three witnesses are examined, however after appointment of the new Advocate again cross-examination of the witnesses is going on. Till today, two witnesses have been cross-examined and so far as witness No.3 is concerned, the summons seems to have
2 33 BA 404.26 been issued. It further appears that though the applicant is behind bars since 16/07/2021, for one or the other reason, the matter was adjourned. It cannot be denied that the applicant is not responsible for the delay.

Considering the above facts and circumstances of the case, this Court is not inclined to grant bail, however the learned counsel for the applicant seeks withdrawal of the application with liberty to approach once again before this Court after six months, in case the trial is not concluded within six months.

Permission granted.

Application is disposed of with liberty as prayed for.
