This Petition is at Serial No. 49. At 11:00 am, Mr. Sanket Palnitkar, learned Advocate for the Applicant made a request to take up this matter out of turn as he is an outstation Counsel. Request made by him is not opposed to by Mr. Ameet Palkar, learned APP. As such, this matter is taken up out of turn post lunch. 2.

By the present Bail Application, the Applicant has sought for the following relief in terms of prayer clause (B):- B.

The applicants may kindly be ordered to be released on bail in connection with crime no. 05/2023 came to be registered in for the U/S 364, Arjun

49-BA-461-2026.doc 302, 201, 120-B , 34 of Indian Penal Code.

After having heard the matter for sometime, Mr. Sanket Palnitkar, learned Advocate for the Applicant on instructions from the Applicant seeks leave to withdraw the present Application with liberty to move the Trial Court after a period of 6 months from today if there is no progress in trial. The request made by Mr. Sanket Palnitkar, is not opposed to by Mr. Ameet Palkar, learned APP for the Respondent - State.

In view of the statement made by Mr. Sanket Palnitkar, learned Advocate for the Applicant, leave is granted to withdraw the present Bail Application with liberty as prayed. 5.

If any fresh Bail Application is filed before the Trial Court after 6 months in the event there is no progress in trial, same be considered on its own merits and in accordance with law. 6.

Bail Application No. 461 of 2026 is disposed of as withdrawn.
