The learned counsel for the applicant submits that though he has raised the ground of "delay in trial" before this Court, however, the same was not raised by the applicant before the trial Court. 2.

In this view of the matter, the learned counsel for the applicant, on instructions, seeks permission to withdraw the present application with liberty to raise the said ground before the trial Court. 3.

Permission granted. The Criminal Application is disposed of as withdrawn, with liberty as prayed for.
