By this application, the applicant is seeking bail in connection with Crime No.662/2025 registered with Police Station Khapa, Dist. Nagpur for the offences punishable under Sections 310(2), 204, 111(2)(b), 351(2), 115 of the Bharatiya Nayaya Sanhita.

The learned counsel for the applicant submits that one of the co-accused is already released by this Court vide order dated 09/04/2026 namely Ashish Vinod Sharma and the applicant is also standing on the same footing, therefore he claims parity. He further submits that this Court has passed the order in detail after considering the material on record and the same material is also against the applicant. Considering the facts that the applicant is
2 30 BA 484.26 behind bars since 18/11/2025 and now the investigation is complete, charge sheet is filed and there are no criminal antecedents, the applicant be released on bail. 4.
On the other hand, the learned APP submits that though the applicant is standing on the same footing as of Ashish Vinod Sharma to whom this Court has granted bail on 09/04/2026 in criminal application No. 358/2026, however, the only difference is that there was recovery of Rs. 3000/- from the applicant, therefore considering this facts the applicant may not be released on bail. 6.
I have considered the rival submissions, I have gone through the order dated 09/04/2026 passed in criminal application No. 358/2026. It appears from the record that except recovery, all the allegations are similar to Ashish Vinod Sharma. Considering the fact that the applicant is behind bars since 18/11/2025 and now the investigation is complete, charge sheet is filed and for the same reasons recorded in order dated 09/04/2026, the applicant can be granted bail, hence the following order:-

ORDER
(i) Criminal application is allowed and disposed of. (ii) The applicant/accused Jitendra S/o Kishor Lambate be released on bail in connection with Crime No.662/2025 registered with Police Station Khapa, Dist. Nagpur for the offences punishable under Sections 310(2), 204, 111(2)(b), 351(2), 115 of the Bharatiya Nayaya Sanhita on his furnishing P.R. Bond of Rs. 25,000/- with one local surety in the like amount.
(iii) The accused shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence.
(iv) The accused shall provide his residential address and cell number to concerned Police Station and shall not change his place of residence without prior intimation to the concerned Investigating Officer.
(v) The applicant/accused shall attend each and every date of trial regularly. If he fails to attend the trial for two consecutive dates or fails to comply with the aforesaid conditions, his default would entails the State to ask for cancellation of bail.
