By this application, the Applicant is seeking regular bail in Crime No.208 of 2024 registered at Khadak Police Station, District : Pune City, for the offences punishable under Sections 307, 324, 323 and 506 read with Section 34 of the Indian penal Code, Section 4(25) of the Arms Act, Section 37(1) read with Section 135 of the Maharashtra Police Act and Section 3 and 7 read with Section 142 of the Criminal Law Amendment Act.

It is prosecution's case that on 16.06.2024, applicant and coaccused assaulted the first informant and his family members with intention to kill them.

It is contention of learned counsel for the applicant that the
applicant is behind bars for around two years and trial is not commenced. The co-accused having similar allegations have been released on bail, hence applicant is entitled for bail on principle of parity and requested to allow the application.

It is contention of learned APP that the applicant and coaccused assaulted the first informant and his family members with intention to kill them. They have suffered serious injuries. If the applicant is released on bail, he may abscond or threaten prosecution witnesses. Hence, requested to reject the application.

I have heard both the learned counsel. Perused chargesheet and documents produced on record. The applicant is behind bars for around two years. The co-accused having similar allegations have been released on bail. It may take time to conclude the trial. Considering these facts, I pass following order.
ORDER
(i) Criminal Bail Application is allowed.
(ii) The applicant is directed to be released on bail in connection with Crime No.208 of 2024 registered at Khadak Police Station, District : Pune City, on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;
(iii) The applicant shall not commit any other crime; (iv) It would be open to the prosecution to file an application for cancellation of bail, if the applicant commits breach of any of the conditions;
(v) Application stands disposed of accordingly.
