By way of this application, the applicant is seeking temporary bail for a period from 19.04.2026 to 22.04.2026 to attend last rites of his father i.e. Dashkriya and Chaudavi. The applicant was arrested on 27.08.2025 in connection with Crime No.379/2025 registered with Parseoni Police Station, District Nagpur for the offence punishable under Sections 103(1), 109(1) of the Bharatiya Nyaya Sanhita, 2023.

As the matter was listed today, it appears that the ritual i.e. Dashkriya is already over. However, it appears from the invitation card that there is 14th day ritual of his late father on 22.04.2026.

The learned Counsel for the applicant submits that the applicant was released at earlier point of time on temporary bail under police escort as his father had died on 11.04.2026 and there was no untoward incident. And therefore, this application may be allowed.

On the other hand, the learned APP submits that when earlier the applicant was released on temporary bail on 11.04.2026, the situation was about to get out of control as near-about 100 to 150 persons had gathered. He further submit that the applicant has already attended the funeral and there are other members in the family of the applicant i.e. his two brothers who can perform further rituals and therefore application is prayed to be rejected.

I have considered the rival submissions. It appears that 14th day program is on 22.04.2026. At earlier point of time i.e. on 11.04.2026 the applicant was released on temporary bail for a day i.e. for 11.04.2026 under police escort for attending the funeral of his father.

Considering the limited prayer, and in the interest of justice, in my opinion, the applicant can be released on temporary bail only for 22.04.2026 under the police escort. Hence the following order : (a) The application is allowed and disposed of. (b) The applicant be released on temporary bail in connection with Crime No.379/2025 registered with Parseoni Police Station, District Nagpur for attending the 14th day ritual of his late father between 10.00 am to 4.00 pm on 22.04.2026 under police escort on furnishing P.R. bond of Rs.25,000/- with one surety in the like amount. (c) The applicant on 22.04.2026 after 4.00 pm shall return back to the jail.

3 1.ba.555.2026 (d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence.

(e) Needless to mention that, it is for the Jail Authority and Police Authority to determine how many persons would be required in the escort and provide the same on payment of charges as per rules.

With this observation, the application stands disposed of accordingly.
