The present application is filed seeking regular bail in Crime No.269/2025 for the offences punishable under Sections 103(1), 238(1) and 3(5) of the Bharatiya Nyaya Sanhita, BNS, 2023, registered with Police Station Shirajgaon Kasba, District Amravati.

On 10/07/2025, while the informant police constable was on duty at Police Station Shirjagaon Kasba, he received information through Dial 112 regarding the presence of a dead body of an unidentified woman lying beneath a bridge near Brahmanwada Road. Acting upon instructions, the

police team reached the spot and found a decomposed body of a female, approximately aged 28-32 years, wrapped in a blanket with hands and legs bound. The body was in a highly decomposed condition and was found lying in water. Prima facie, it appeared that, the deceased had been strangulated and thereafter disposed of with an intention to destroy evidence and conceal identity. Based on the said information, the F.I.R. was lodged.

The learned counsel for the applicant submits that, so far as the main accused - Anil Zanakram Jambhekar is concerned, he was granted bail by the Incharge Additional Sessions Judge-3, Achalpur. He submits that, while granting bail to Anil Jambhekar, a detailed order has been passed and reasons have been given, wherein it is stated that Anil Jambhekar was having love affair with deceased - Durga and he has killed deceased - Durga. So far as the present applicant is concerned, the role assigned in the order dated 25/02/2026, is that Anil Jambhekar and present applicant has carried dead body of Durga and thrown it at Bagadi Canel. The learned counsel further submits that another Court, i.e., Additional Sessions Judge-1, Achalpur, District Amravati, on the application of the present applicant, on 30/03/2026 has rejected the bail application,

though the main accused - Anil Jambhekar was already released on bail by the Incharge Additional Sessions Judge-3, Achalpur, by its order dated 25/02/2026. He submits that when Anil Jambhekar, who was the main accused, who was having love affair with deceased - Durga, and there are other circumstances alleged against the said Anil Jambhekar, has been granted bail, however, when there is no active role attributed to the present applicant his application was rejected. Therefore, he prayed that the applicant be released on bail as the main accused has been released on bail by the trial Court.

The learned A.P.P. strongly opposes the application and submits that though the main accused is Anil Jambhekar, but both have committed murder by strangulating the deceased with scarf and had thrown her body in Bagadi Canal. She concedes to the fact that there is no material to show that the dead body was carried on the motorcycle by the applicant along with main accused - Anil Jambhekar. However, she submits that considering the seriousness of the crime, bail may not be granted. 6.

I have considered the rival submissions.

I have gone through the orders of the trial Court of Anil Jambhekar and present applicant. It appears

from the record that Anil Jambhekar was having a love affair with deceased Durga. Deceased - Durga was insisting for money for purchasing house property due to which Anil Jambhekar was fed up, and therefore, strangulated the deceased - Durga with the help of Anil Nagle, i.e., the present applicant. From the record, prima facie, it appears that, the Incharge Additional Sessions Judge-3, Achalpur, has recorded detailed reasons while releasing main accused - Anil Jambhekar on bail, however, the reasons assigned by the Additional Sessions Judge-1, Achalpur, District Amravati, while rejecting the bail application of the present applicant by its order dated 30/03/2026, are cryptic.

Judicial propriety demands that once the bail is granted to the main accused, then the trial Court ought not to have rejected the bail application of other co-accused. The only material against the present applicant is in the nature of confession, that too, by the main accused - Anil Jambhekar, wherein he has named the present applicant, which is inadmissible.

inclined to grant bail by imposing stringent conditions. Hence, the following order:-

O R D E R

(i) The Criminal Application is allowed;

(ii) The applicant/accused (Anil @ Sandip s/o. Savnya Nagle) be released on regular bail in connection with Crime No.269/2025 for the offences punishable under Sections 103(1), 238(1) and 3(5) of the Bharatiya Nyaya Sanhita, BNS, 2023, registered with Police Station Shirajgaon Kasba, District Amravati, on his furnishing a P.R. bond of Rs.50,000/- (Fifty Thousand Rupees) with two solvent sureties in the like amount;

(iii) The accused shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence;

(iv) The accused shall provide his residential address and cell number to Police Station concerned and shall not change his place of residence without prior intimation to the Investigating Agency;

(v) The accused shall attend each and every date of trial regularly. If he fails to attend the trial for one single date, or fails to comply with the aforesaid conditions, his default would entail the State to ask for cancellation of bail; (vi) The above observations are prima facie in nature, and restricted for the purpose of deciding this application. The Trial Court shall not get itself influenced by said observations, during the course of trial.

(vii) Pending Misc. Application(s), if any, also stand disposed of.
