By this application, the applicant is seeking bail in connection with Crime No.662/2025 registered with Police Station Khapa, Dist. Nagpur for the offences punishable under Sections 310(2), 204, 111(2)(b), 351(2), 115 of the Bharatiya Nyaya Sanhita.

The learned counsel for the applicant submits that this Court by an order dated 09/04/2026 has granted bail to one co-accused namely Ashish S/o Vinod Sharma in Criminal Application (BA) No. 358/ 2026. While releasing him on bail, this court in paragraph No. 6 has given detailed reasons for his release. The learned counsel for the applicant submits that the present applicant is also standing on the same footing and therefore he deserves
2 41 BA 573.26 parity. The role attributed to Ashish Vinod Sharma is absolutely identical to the present applicant, therefore he submits that on parity, the applicant deserves bail. 4.
The learned APP concedes to the above mentioned fact and submits that the role played by Ashish Vinod Sharma and the present applicant is similar. Therefore, she agrees that the observations given by this Court in para No.6 is also applicable to the present applicant. 5.
I have considered the rival submissions. I have perused the order dated 09/4/2026. Considering the fact that Ashish Sharma has been granted bail by this Court and the present applicant is also standing on the same footing, I am inclined to grant bail by adopting the reasons in para No. 6 of the order dated 09/04/2026, hence the following order:-
ORDER
(i) Criminal application is allowed and disposed of. (ii) The applicant/accused Badal S/o Ramesh Bokade be released on bail in connection with Crime No.662/2025 registered with Police Station Khapa, Dist. Nagpur for the offences punishable under Sections 310(2), 204, 111(2)(b), 351(2), 115 of the Bharatiya Nyaya Sanhita on his furnishing P.R. Bond of Rs. 25,000/- with
3 41 BA 573.26 one surety in the like amount.
(iii) The accused shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence.
(iv) The accused shall provide his residential address and cell number to concerned Police Station and shall not change his place of residence without prior intimation to the concerned Investigating Officer.
(v) In case the accused commits further similar type of offence, the prosecuting agency/investigating agency/prosecution is at liberty to file the application for cancellation of bail in this crime.
(vi) The applicant/accused shall attend each and every date of trial regularly. If he fails to attend the trial for two consecutive dates or fails to comply with the aforesaid conditions, his default would entail the State to ask for cancellation of bail.
