It appears that the applicant is seeking regular bail in connection with Crime No.802/2025 registered with Frezarpura Police Station, District Amravati for the offence punishable under Section 223 of the Bharatiya Nyaya Sanhita (BNS), 2023, which is registered against the applicant for using mobile phone in the jail. 3.

Learned APP submits that though the offence was registered against the applicant for using mobile phone in the jail, however he was not arrested in the present crime i.e. Crime No.802/2025.

The said statement finds place in paragraph 1 of the reply filed by the APP. The applicant was convicted and is undergoing life imprisonment in another crime. In view of the fact that the applicant has not been arrested in the present crime, the application seeking regular bail is not maintainable; hence, the same is rejected. (M.M. NERLIKAR , J.
